How is the landscape on the use of independent contractors affecting the Trucking Law Practice?
I am with an insurance company, so difficult to answer relative to a law practice on the question of how the use of independent contractors may affect it. I would say as an insurance carrier, it adds complexity to coverage analysis and additional litigation.
What’s the Impact of New Technology on Trucking Litigation?
The impact of new technology on trucking litigation has been two fold in my opinion. First it has been a great asset in determining the facts of loss without relying on human interpretation. Increased use and functionality of on-board cameras and electronic control modules has vastly improved the ability to determine objectively fault in a loss and to litigate accordingly. The second impact is these features have increased the cost of litigation due to the additional experts and discovery required.
Where are the Liability trends for Brokers and Third Party Logistics Company?
I believe the liability arguments and litigation against Brokers and Logistics companies will continue.
